Welcome to the Photo Tours Adventures website (the “Site”). These Terms and Conditions (“Terms”) govern your use of this Site and the services provided by Photo Tours Adventures. By accessing or using this Site, you agree to comply with and be bound by these Terms. If you disagree with these Terms, please do not use the Site.

1. Use of the Site

1.1 Eligibility

To use this Site, you must be at least 18 years old or have the legal capacity to form a binding contract. By

using the Site, you represent that you meet these eligibility requirements.

1.2 Permitted Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You must not:

Use the Site in any way that breaches applicable local, national, or international law or regulation.

Engage in any conduct that is unlawful or fraudulent.

Attempt to gain unauthorised access to the Site, the server on which it is stored, or any server, computer, or database connected to the Site.

Use the Site in any way that could damage, disable, overburden, or impair the Site or interfere with any other party’s use of the Site.

2. Intellectual Property Rights

All content on the Site, including text, images, videos, graphics, logos, and software, is the intellectual property of Photo Tours Adventures or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or otherwise use any content from the Site without prior written permission from Photo Tours Adventures, except as expressly permitted by these Terms.

3. Booking, Deposits, and Payments

3.1 Booking Confirmation

Your booking will be confirmed once a deposit is received and a confirmation email is sent to you by Photo Tours Adventures. Full payment for all adventures is due 120 days before the start date. Full payment must be received before your spot on the tour or workshop is guaranteed.

3.2 Deposit and Refund Policy

A deposit is required at the time of registration.

Refunds:

You will receive a full refund if you cancel more than 120 days before the start date.

Cancellations made between 120 and 91 days before the start date will be eligible for a 75% refund.

Cancellations between 90 and 61 days before the start date will receive a 50% refund.

Cancellations made within 60 days of the start date are non-refundable.

For private photo adventures, full payment is due 150 days before the start date and is non refundable.

4. Rescheduling Policy

4.1 Guest Rescheduling Policy

If you need to cancel but would prefer to attend a future adventure, you may opt to reschedule:
Rescheduling more than 120 days before the start date allows your payment to be transferred to another adventure without any additional fee.
Rescheduling 120 and 61 days before the start date will incur a $400 / £400 fee.
Rescheduling within 60 days of the start date is not allowed.
Rescheduling is subject to availability and does not apply to private adventures.

4.2 Company Rescheduling Policy

In exceptional cases where safety concerns arise due to political instability, natural disasters, or other

emergencies, Photo Tours Adventures reserves the right to reschedule or cancel the adventure. In such

cases, you may either accept the new dates or apply your payment towards a different adventure.

5. Cancellation Policy

5.1 Cancellation by Photo Tours Adventures

If we need to cancel an adventure due to low enrolment or other reasons, you will have the following options:

(a) transfer to another adventure during the same period,

(b) transfer to the same adventure at a later date,

(d) accept a special offer or

(e) request a full refund.

If you choose to reschedule, we will adjust your dates and provide up to a $300 flight change fee credit to help with the cost of changing your flight.

6. Additional Information

Accommodations: All accommodations are based on double occupancy. If you prefer a private room, please select the private room/single supplement option when booking.

Exclusions: The tour package does not cover alcoholic beverages, unscheduled meals, transportation to and from our destinations, airport transfers, travel insurance, or any optional excursions you book independently or with the group. Breakfast is typically included unless otherwise specified by the hotel package.

Itinerary Adjustments: We may need to alter the events and schedule outlined in the itinerary Due to adverse weather conditions or unforeseen circumstances beyond our control. The safety of everyone remains our top priority.

7. Travel Insurance

We strongly recommend that all participants obtain travel insurance to cover trip cancellations, medical emergencies, and other unexpected incidents. Photo Tours Adventures is not responsible for any medical costs or losses incurred during the tour.

8. Code of Conduct for Tours

All participants are expected to:

Behave respectfully towards other participants, guides, and local communities.

Comply with all safety instructions provided by guides or instructors during the tour.

Refrain from disruptive, inappropriate, or illegal behaviour during the tour.

Failure to comply with these rules may result in removal from the tour without a refund.

9. Photo & Media Release

By participating in our tours, you agree that Photo Tours Adventures may take photographs and videos during the tour and use them for promotional and marketing purposes. If you do not wish to appear in any media, please inform us in writing prior to the tour.

10. Age Restrictions / Accessibility

Participants must be at least 15 years old to join our tours. Minors must be accompanied by a parent or legal guardian.

Some tours may involve physical activity, such as hiking or walking over uneven terrain. You are responsible for ensuring that you are physically capable of completing the activities outlined in the itinerary.

11. Health and Vaccination Requirements

Participants are responsible for ensuring they meet the destination’s health and vaccination requirements. We recommend consulting a medical professional before travel regarding vaccinations or health precautions.

12. Liability

Participation in our tours and workshops is at your own risk. Photo Tours Adventures is not liable for any personal injury, illness, or property loss during the tour. It is your responsibility to ensure that you are physically fit and capable of undertaking the activities included in the tour.

13. Force Majeure

Photo Tours Adventures is not responsible for any delay, modification, or cancellation of a tour due to events beyond our control, including but not limited to natural disasters, strikes, pandemics, or other unforeseeable events (“Force Majeure”). In such cases, we will offer an alternative date or a full refund, but we are not liable for any additional costs incurred by the participant.

14. Financial Security and Consumer Protection

Your financial security is guaranteed. You are covered by stringent British travel industry regulations and UK legislation throughout your trip. Your consumer rights are fully protected by the EU Package Travel Regulations governing the sale and operation of every trip we organise.

We have business insolvency insurance to comply with the Package Travel and Linked Travel Arrangements Regulations 2018 (PTRs) and protect you financially. This ensures you are refunded if our business cannot deliver the promised services.

15. Equipment Responsibility

Participants are responsible for the care and security of their photography equipment during the tour. Photo Tours Adventures is not liable for any loss, damage, or theft of personal property, including cameras, lenses, or other photography gear.

16. Privacy

Our Privacy Policy governs your site use and outlines how we collect, use, and protect your data. By using the Site, you consent to collecting and using your data as described in the Privacy Policy.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Dispute Resolution

If any disputes arise from these Terms or the services provided, the parties agree to first attempt to resolve the dispute through good-faith negotiations. If a resolution cannot be reached, the dispute will be submitted to mediation or binding arbitration before seeking legal recourse.

19. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on this page with an updated revision date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

20. Termination

We may terminate or suspend your access to the Site at any time, without notice, if you engage in conduct that violates these Terms or harms other users or the Site.
